Miller v. Gorski Wladyslaw Estate, 338 Fed. Appx. 454 (5th Cir. 2009)
This appeal of a $30 million jury verdict involved a catastrophic collision near Lafayette, Louisiana, that resulted in several deaths and injuries. Beck Redden partner Russell Post was hired to handle legal issues and jury charge matters for the plaintiffs at trial, and he also handled the appeal. The National Law Journal ranked the verdict as one of the top 10 verdicts of 2007. The appeal involved novel questions of Louisiana insurance law and challenges to the size of the substantial non-economic damage awards, and the U.S. Court of Appeals for the Fifth Circuit issued an opinion upholding the jury’s verdict in its entirety.
