October 19, 2012 Case Study

Marcus & Milchap v. Sekulovski

Marcus & Millichap Real Estate Investment Services of Chicago, Inc. (“Marcus & Millichap”) alleged that the Defendant Tony Sekulovski (“Sekulovski”) misappropriated various monies that were due to Marcus & Millichap. The firm represented Marcus & Millichap in seeking damages. Sekulovski had been a commercial real estate agent working as an independent agent for Marcus & Millichap.  When Sekulovski left Marcus & Millichap, he owed certain monies to Marcus & Millichap and took both real estate deals and commissions belonging to Marcus & Millichap. The firm obtained a favorable verdict on all claims, including fraud, breach of contract, conversion, unjust enrichment, tortious interference with an existing contract, and tortious interference with a prospective contract. The trial court entered judgment on the verdict, and the case was affirmed on appeal.
